Master’s Degree in Borders and Human Rights


DESCRIPTION
The Master’s degree program of the Faculty of Law and International Relations of  UFGD is committed to definitely overcoming the disciplinary tradition in the field of law and international relations. This necessity is justified by the fact that the bordering region faces challenges due to the development of these bordering areas of neighboring countries and due to issues regarding the respect of human rights. On one hand, the proposal is to analyze the converging and the diverging relationship concerning economic, political, diplomatic, social and sustainable development between the countries of MERCOSUL, specially Brazil and Paraguay. In addition to that, the program aims at studying the growth and the development of this bordering region focusing on economic growth, social procedures of respect towards the dignity of human person, education, work, migration flows, environment, water resources, trade relations and cultural influence, among others. Such fundamentals are interconnected with the field of Human Rights and Citizenship.
 
SYLLABUS
 
Refugees and Human Rights
The origins of the international movement of refugees in the international relations of the 20th century. The Nansen Phase and the League of Nations. The Nansen Passport and the High Commissioners in the war period. The Geneva Convention of 1951 and the High Commissioners of the United Nations for Refugees. The decolonization of Africa and the problems of forced displacement in Latin America. The Refugee Warriors. The African Union Convention and the Cartagena Declaration of 1984. The role of UNHCR and the Convention Plus in the 21st century. Brazilian policies for refugees before and after Law 9.474/1997.
 
 
Borders and Brazilian Foreign Policy
The process of negotiation and demarcation of the borders of Brazil. The constitution of the several political-economy and social dynamics in the bordering regions. Cooperation and conflict in bordering regions. The relations between Brazil and the countries of the Southern Cone: from distrust to cooperation. International themes and agendas in bordering regions.
 
 
Borders and Regional Integration
This discipline aims at analyzing the concepts and principles related to Regional Integration, its historical background and the process of institutionalization, presenting and discussing about its main political and institutional milestones, and then debate over theoretical readings and interpretations upon Regional Integration. The third objective of this discipline is to analyze the agendas of the most recent processes of Regional Integration and the development of initiatives in the bordering region. Special attention will be given to the analysis of the role of Brazil and the countries of Mercosul as far as integration agendas in the bordering regions are concerned. The intention is to understand the interfaces between the domestic dimensions of these agendas and regional policies.
 
 
Theoretical Fundamentals of International Relations
Introduce concepts, methods and basic themes about the Theory of International Relations, from classic authors to “new” contemporary themes. The objective here is to introduce students to the fundamentals of the main theories related to international relations. Examine the historical evolution of the debates over theoretical themes upon international relations and their applicability, limits and their reach in relations to explaining international phenomena, especially those regarding Human Rights and issues of bordering regions.
 
Guaranteeism and Fundamental Rights
Guaranteeism in postmodernity. The relation between guaranteeism and fundamental rights. Fundamental rights and guaranteeism: a principle approach. Human rights as a philosophical doctrine and the political ideas of modernity. Natural law theory and its variations. Legal positivism and neo-constitutionalism.
 
Globalization and Human Rights
Legal consequences of globalization. Globalization and the State of Law. Sovereignity in the modern world and Human Rights. Human development in bordering regions, violence and social exclusion.
 
 
Scientific Method
This discipline aims at offering graduate students an integrative perspective of different theoretical-methodological views. Special attention will be given to the research projects under development during the course. The intention is to promote a critical dialogue between the social research techniques and their theoretical and methodological implications so that we can contribute to an interdisciplinary scientific production in the Master’s degree program in Borders and Human Rights. Thus, students will be able to improve their ongoing research as far as methodological concepts are concerned, such as: the construction of the scientific field (nature of knowledge, scientific method, scientific demarcation); specific topics in borders; human rights and citizenship; crisis of paradigm and interdisciplinarity.

General Theory of Human Rights
Human rights: origins and their philosophical and historical foundations. The debates around human rights: political order and legal subjects. Human rights in perspective – analytical and normative. Human rights and citizenship in a contemporary context. Local and global citizenship. The divisions and dimensions of human rights. The internationalization process of the human right Project and the Organization of the United Nations. Human rights: methodological propositions and debates. Objectives of the discipline: Offer knowledge about the theoretical debates upon human rights. Present different possibilities of theoretical appropriation about the concept of human rights. Broaden the ideas of human rights and citizenship as historical, political and social developers of the National State. Analyze the process of internationalization of the human right project after World War II, from the creation of the Organization of the United Nations (ONU). Point out the particularities and the methodological concerns regarding human rights as an object of research.
 
 
Theories of Regional Integration
Present the main theories about Regional Integration. Examine the multiple dimensions of integration. Analyze the institutional dynamics and the actions of multilateral organizations in the process of political, economic and social integration in the bordering region of Mato Grosso do Sul.
 
 
Theories of Development
Theories of the development of the marxist, keynesian, schumpeterian and institutionalist inspiration. Comparative study about the theoretical conceptions about economic development. Underdevelopment and the theory of ECLAC. Developmental state. Regional development. International differences and similarities regarding development policies.
 
 
Territory, Borders and Development
Territory and territorialities in bordering regions. Integration and development in bordering regions. Regional development in bordering regions. Economic conflicts. Social mobility in bordering regions. Typology of border relations. The paradoxes of borders. Borders: geopolitics and strategic issues. Urban and rural spaces in bordering regions. Identity and culture in bordering regions.
 
 
Special Topics in Culture, Identity and Borders
This discipline recovers the studies about identity and language. It problematizes the construction of identity in bordering regions and contextualizes culture, the organization of social groups and the multiple languages of bordering regions. CONTENT: Concepts of Culture, Border and Identity; Identity, Cultural Hybridism and Cultural Borders; Borders and their multiple languages. Material and immaterial issues in a debate: language, literature, cinema, architecture, handcraft, music, religion and religiousness, social and family organization, etc.; Development of research activity.
 
 
Special Topics in Human Rights, Citizenship and Borders
Introduce and deepen theoretical knowledge, concepts and research methods about actors and themes regarding human rights, citizenship and borders. The idea is to stimulate the debate about several themes, from public policies, minority rights, among other similar issues.
 
 
Special Topics in Borders, Integration and Development
Introduce and deepen theoretical knowledge, concepts and research methods about actors and themes regarding borders, integration and development. The idea is to stimulate the debate about several themes, from transnational illegal practice to migrating populations.
